Jerry
H. Stein
Jerry H. Stein, a Washington licensed lawyer, is an Order of the Coif honoree
from the UCLA School of Law and has more than 25 years of experience in litigating
and resolving construction
and
other real estate related disputes.
Jerry has tried more than 30 cases and is
one of the few construction defect attorneys to have actually
tried a construction defect case on behalf of a condominium association.
With Jerry Stein as lead trial counsel, the jury awarded the
Lake Meridian Association approximately $3 million dollars in
damages against the developer. The $3 million dollar verdict
represented a recovery of 100% of the damages sought by the Association.
Jerry Stein was one of the first attorneys
to obtain a pre-trial writ of attachment on behalf of a condominium
association that enabled a court to obtain jurisdiction over
a developer’s assets while suit was pending. This prevented
the developer from disposing of those assets while the association’s
claims were still in the dispute resolution process.
In addition to his work as trial counsel, Jerry also has extensive appellate
experience. In a precedent setting published opinion involving the Marina Cove
Condominium Association, Jerry was able to convince the Appellate Court that
an association’s right to a jury trial on its damage claims prevailed
over the standard provisions in a developer’s sales agreement purporting
to compel the Association to arbitrate any claims that it might have against
the developer.
