Q: What are the rights of an association involving a multi family housing project that is not a condominium?
A: In Oregon, many multi-family housing projects are not developed as condominiums. Townhomes or row home projects, for example, may or may not be governed by the Oregon Condominium Act even though a single building may include more than one home. If a single residential structure involves multiple homes and the project is not governed by the Oregon Condominium Act, homeowners (and the association) are given the protections of the owners of single family homes. These protections include the Oregon Common Law Warranties of construction quality as well as other protections that Oregon law provides for the owners of single family homes. Please refer to the single family home question and answer section of our website for further discussion of single family homeowner rights as those rights will apply to the owners of most residential property (other than apartment projects) not governed by the Oregon Condominium Act.
