Jerry Stein, the founding and managing partner of the firm, has more than 35 years of experience in litigating and resolving insurance coverage issues, construction, and other business and real estate disputes. Jerry has tried more than 30 cases.
Under Jerry’s guidance, the firm has been in the forefront of representing condominium associations and apartment owners in pursing claims against property insurers for damage caused by long-term exposure to wind and rain. Within the last 5 years, the firm has obtained seven significant court rulings that helped establish an association or owner’s right to pursue claims against old, expired insurance policies and also establish that coverage exists when long-term exposure to wind driven rain combines with inadequate construction cause hidden damage to the building’s exterior walls. In large part due to these rulings, the firm has successfully settled more than 45 of these hidden water damage cases.
When it comes to first-party claims, nobody has done more than Jerry. His extensive experience in this arena is unparalleled, having been involved in a staggering number of mediations. His proficiency in representing clients during these critical negotiating stages has often been the linchpin in securing favorable outcomes.
In addition to his work as trial counsel, Jerry also has extensive appellate experience. In a precedent setting published opinion involving the Marina Cove Condominium Association, Jerry was able to convince the appellate court that an Association’s right to a jury trial on its damage claims prevailed over the standard provisions in a developer’s sale agreement purporting to compel the Association to arbitrate any claims that it might have against the developer.
Jerry is an Order of the Coif honoree (graduated top 10% of the class) from the UCLA School of Law. He lectures and writes regularly on a wide variety of insurance and litigation related issues. Jerry is also licensed to practice law in Hawaii.
